1. What is Personal Information?

Personal Information is personally identifiable information such as your name, telephone number, email address and any other non-public information about you that is associated with or linked to any of the foregoing information. Personal information does not include aggregate information, which is general user data we collect about the use of Beepings. Our Privacy Policy does not restrict or limit our collection and use of aggregate information.

2. What Personal Information Does Beepings Collect?

2.1 Information you provide for the use of technology

– Registration and Profile Information. When you create an account, we may collect your personal information such as your username, first and last name, birth date, email address, mobile phone number and a photo, if you choose to have a photo associated with your account. If you want to add a child or family member’s name to your account, we collect the child or family member’s name, email address, and mobile phone number. We may collect billing information when you sign up for the Premium service. We may collect additional information from a parent in order to obtain verifiable parental consent to allow a child to use the Beepings Service. When you register in our app with social media, such as Facebook, we receive information from the social network such as your profile information, profile picture, gender, user name, user ID associated with your social media account, age range, language, country, and any other information you permit the social network to share with third parties. The data we receive is dependent upon your privacy settings with the social network.

– Location Services. We collect your location through GPS, WiFi, or wireless network triangulation in order to obtain your location for the purposes of providing the Beepings Service. Beepings is also using location services in the background to provide a key safety feature: so the parent users can get real-time geofence alerts from their children. While you are logged in to your account and have location services enabled, we will continue to collect your location information in order to provide the Beepings Service (for example, to provide the Beepings Services or to share your location with the members you allow to see your location). We maintain location information only so long as is reasonable to provide the Service and then delete the location data.

– Messages and User Content. We collect information when you message other members of your Family through the use of the service. We may also retain any messages you send to us.

Beepings only collects “sensitive” personal information when you voluntarily provide us with this information or where such information is required or permitted to be collected by law or professional standards. Sensitive information includes personal information regarding a person’s race, ethnicity, political, philosophical religious or similar beliefs, trade union membership, physical or mental health, sexual life, sexual orientation, or criminal record. 2.2 Automatically collected information through the use of technology:

When you use the Beepings Service, we may collect certain information about your computer or device through technology such as cookies, web beacons, log files, or other tracking/recording tools. The information we collect through the use of tracking technologies includes, but is not limited to, IP address, browser information, referring/exit pages and URLs, click stream data and how you interact with links on the website, mobile app, the Beepings Service, domain names, landing pages, page views, cookie data that allows us to uniquely identify your browser, browsing behavior on our site, mobile device type, mobile device IDs or other persistent identifiers, and location data collected from your mobile device. Some or all of this data may be combined with other personally identifying information described above.

– Remember information so that you will not have to re-enter it during your visit or the next time you use the Beepings

– Provide custom, personalized content and information

When using Beepings connected objects and the Beepings application, Beepings may collect your GPS position and scan nearby WiFi hotspots in order to optimize the positioning accuracy of the objects and/or to transmit a reference position to the user when using Beepings connected objects.
This data is stored on our servers and will not be transmitted or used for marketing purposes outside Beepings and its solutions.

2.3 Driving Event Data:

We collect, and may use a third-party partner to collect, sensory and motion data from your smartphone or mobile device, including information from the gyroscope, accelerometer, compass and bluetooth, in order to calculate and detect driving events such as speeding, hard braking, crash detection and other events. If you want to opt-out, please adjust your settings in your mobile device to limit the app’s access to your sensory and motion data.

2.4 Children’s Privacy:

Beepings allows parents to keep track of their children’s location on mobile devices that the parent has added to their account. The service is intended to be used by children under 13 only with parental approval. If a parent wishes to add a User who is under 13 to the Family account, the parent must send Beepings Parental Consent via email. The child’s personal information will be shared with other members of the family account. Beepings may then use the child’s personal information as described in this Privacy Policy. However, we do not use or share personal information collected from the accounts of children under 13 for marketing or advertising purposes.

3. How Does Beepings Use Personal Information?

Generally, Beepings collects, stores, uses and discloses information to enable us to:

3.1 Third Party Analytics

We may also collect analytics data, or use third-party analytics tools, to help us measure traffic and usage trends for the Beepings Service. Tools like Appsflyer, Flurry and Firebase collect information sent by your browser or mobile device, including the pages you visit, your use of third-party applications, and other information that assists us in analyzing and improving the Service. Anonymous aggregate statistics that do not personally identify the Users will be kept and used by us for various purposes including analysis and reporting of usage patterns.

When you access the Beepings Service by or through a mobile device, we may receive or collect and store a unique identification numbers associated with your device or our mobile application (including, for example, a UDID, Unique ID for Advertisers (“IDFA”), Google Ad ID, or other identifier), mobile carrier, device type, model and manufacturer, mobile device operating system brand and model, phone number, and, depending on your mobile device settings, your geographical location data, including GPS coordinates (e.g. latitude and/or longitude), WiFi location or similar information regarding the location of your mobile device.

3.2 Integrated IoT Partners

For our IoT users: please be aware that Beepings may receive the following data from our partner devices: anonymized authorization token, anonymous account ID, SOS signal, tracker ID, anonymous location data. These data do not contain any user details and are used solely to trigger SOS alerts to circle members inside Beepings mobile app.

4. How Does Beepings Share Your Personal Information?

We share your personal information, including name, email, location and driving event data, with others within your Beepings circles.

Any information or content that you voluntarily post to our App Store and Google Play Store, or our social media pages will automatically be available to the public. We may publicly post your reviews and comments online.

From time to time, we may employ third parties to help us provide or improve the Beepings Service. These third parties, such as our analytics or hosting provider, may have limited access to databases of user information or registered member information solely for the purpose of helping us provide or improve the Service and they will not be able to use the information about our members or visitors for any other purpose. We may disclose personal Information in some other limited circumstances, but we will specifically describe them to you when we collect the information, such as in the terms of use for a new service or by revising this Privacy Policy.

ARTICLE 2 – USER or USERS

2.1 Capacity

The Site, its Application and its services are intended for people with legal capacity. By accessing and using the Site or its Application, the User declares and guarantees to be of legal age and capable or to be a legally constituted entity (hereinafter the “User or Users”).

2.2 User or Users

2.2.1 Registration and confidentiality

By using Beepings, the User declares, guarantees and undertakes to:

ARTICLE 3 – PRODUCTS

Users benefit from a free dedicated smartphone geolocation application (the “Application”) allowing a simplified search for their objects, goods, animals or people, connected using a tag (the “Zen Beepings”).

When activating on the Application, the User can personalize the Beepings Zen by associating a photo or an image which must be free of copyright.

The Application can be downloaded from the Apple Store and Google Play platforms.

3.1 Zen Beepings

The “Beepings Zen” is a GPS beacon using SIGFOX technology operating on the basis of a low frequency network present in many European countries (hereinafter the “Coverage Territory”).

The Coverage Territory is available on the website http://www.sigfox.com/coverage.

The User can, via the Application, view the position of the Beacon within the limits of the Coverage Territory.

The User acknowledges having read the duration of the battery under optimal conditions of use. The duration is mentioned for information only. The User is invited to regularly check the state of the Beepings Zen battery.

The User acknowledges being fully informed about the storage by Beepings of information relating to the location history of the Beepings Zen since its activation. The User can view the history via the Application by logging in using their User IDs.

All the technical characteristics of Beepings Zen can be viewed on the Site.

For any purchase of a Beepings Zen, Beepings undertakes to deliver a product conforming to the characteristics present on the Site.

3.2 Geolocation application

Users are informed that, for the purposes of the functioning of the Application, Beepings collects and processes geolocation data thanks in particular to the following Google APIs:
– Google Maps,
– Google Places (autocompletion of addresses),
– Google Geocoder (reverse Geocoding).

Beepings reserves the right to use APIs from other partners if necessary, without expressly informing users.

ARTICLE 4 – USE OF THE SITE AND THE APPLICATION

The services offered by Beepings are freely and exclusively accessible on the Application after opening a User Account and activating Beepings Zen.

Beepings uses its best efforts to make the Application and its services available 24 hours a day, 7 days a week, except for maintenance operations or force majeure and within the limits of the Coverage Territory with regard to Beepings Zen .

Beepings reserves the right to modify, interrupt, at any time, temporarily or permanently, all or part of the Site and its Application, without prior notice to the Users and without right to compensation.

This accessibility cannot be guaranteed in the event of a malfunction of the SIGFOX network or of the required radio frequencies, in particular fixed and mobile Internet access.

The reproduction, representation and adaptation of the “Beepings” brand are strictly prohibited in any form whatsoever, unless expressly authorized in writing by Beepings.

5.3 Photos

The submission of a photo by a User in order to identify his Zen Beepings is possible but is not compulsory. This deposit is made under its responsibility.

The User declares that he is the owner of the copyright relating to the photos published on the Site and the Application.

5.4 Right of database producers

Beepings recalls that the rights recognized to Beepings, in its capacity as producer of the database, implies prohibition for anyone to:

  • the extraction, by permanent or temporary transfer of all or a qualitatively or quantitatively substantial part of the content of a database on another medium, by any means and in any form whatsoever,

  • reuse, by making available to the public all or a qualitatively or quantitatively substantial part of the content of the base, whatever its form,

  • the repeated extraction or reuse of qualitatively or quantitatively insubstantial parts of the content of the database when these actions do not correspond to normal use of the database.

    Any User undertakes, therefore, not in particular to carry out data mining (Data mining) to extract data, properties exclusive to Beepings.

    ARTICLE 6 – PERSONAL DATA

    6.1 Collection of personal and banking data

    6.1.1 Personal data

    The data indicated as mandatory in the registration form for the opening of a User Account requires an exact response from the User. Any failure to respond or any response deemed abnormal by Beepings may result in Beepings refusing to take into account the registration.

    Beepings undertakes to protect personal data and to keep it strictly confidential.

    Beepings undertakes to implement all means to guarantee the Security and confidentiality of its personal data to the User.

    6.1.2 Bank details

    Bank data (bank card number, validity dates, security cryptogram, etc.) necessary for the purchase on the Site of a product or service from Beepings is not collected or stored by Beepings but only by the provider of the online payment module.

    6.2 Protection of personal and banking data

    6.2.1 Declarations to the CNIL

    Beepings provides Users, the Application and the Products to allow them to geolocate their objects, goods, animals and people who have consented.

    Beepings declines any responsibility linked:

    – linked to the technical consequences of the connection to the Site or the Application, in particular in the event of connection difficulties due to a technical or material defect, or any problem linked to congestion on the network or the Smartphone of the User;

    – linked to the technological limits of antennas and GPS satellite signals and of the SIGFOX network. The transmission of Sigfox radio messages and the acquisition of GPS signals are systems which have limits which are highly dependent on conditions of use and the environment. Beepings does not guarantee performance, reception of signals or the interval between monitoring;

    – linked to any material or immaterial damage caused to the User or to third parties as a result of the use of the Site or the Application, as well as to the consequences which may result from this on the personal, professional or commercial activities of Users;

    – linked to the consequences on the User or a third party resulting from a violation by the User of the guarantees and obligations referred to in article 2.2 of these general conditions;

    – linked to direct and indirect damage resulting from the loss of objects, property, animals or people provided with a Beepings Zen and which however could not have been found insofar as Beepings is only required to ‘an obligation of means and this, within the limit of the Coverage Territory with regard to Beepings Zen;

    – linked to the non-performance or poor performance of Beepings’ obligations attributable either to the behavior of the User, or to the fact, unpredictable and insurmountable, of a third party to the contract, or to a case of force majeure; linked to the failure of the geolocation service or Beepings Zen due to one of the following events:

    – Failure, insufficiency or congestion of GSM, GPRS and GPS coverage;

    – Failure, insufficiency or congestion of the SIGFOX network;

    – Failure, breakdown, alteration or deliberate or involuntary deterioration of the product (Beepings ZEN), battery discharged or having suffered a damage such as to prevent its operation;

    – Malfunctions consecutive to the situation of the equipment in electromagnetic fields disturbing the data transmissions – or in covered places disturbing the emission or the reception of the data or the access to the coverage (GSM or GPS);

    – Works, interventions or manipulations carried out on the Application, the Site, the Beepings Zen or the servers used to provide the geolocation service;

    – Inaccuracy or lack of updating of the data provided by the User.

    The User acknowledges that:

    Beepings cannot assume the connection costs, and in general, any communication costs incurred by accessing the Site or the Application and by its use by the User;

    Beepings strives to provide only a geolocation of Beeping Zen. The company cannot therefore guarantee, as the case may be, the nature of the object, the good or the identity of the person on whom the Beacon is shipped;

    Beepings cannot be held responsible for any loss of data, which may occur during the use of the Site or the Application and / or the impossibility of accessing or using these;

    Beepings clearly informed him about the Coverage Territory. The User is solely responsible for: use that does not comply with these general conditions of use for the Site and its Application; any complaint or procedure brought against Beepings, due to its non-conforming use of the Site, the Application or the Beepings Zen.

    In any event, Beepings’ liability is limited to the reimbursement of the price of Beepings Zen.

    The law applicable to these general conditions is French law.

    The language of interpretation is the English language.

    “Application”: refers to the Smartphone application downloadable from the Apple Store and Google Play, allowing you to join the Beepings community and have all the features offered by Beepings products. The Beepings app is free.

    “Beepings or Beepings SAS or Société Beepings”: designates the company Beepings, a simplified joint-stock company with capital of € 1,333.60, whose registered office is located at 7 rue Cadet – 75009 Paris – France, registered in the Trade and Paris companies under the number 811 396 407, Intracommunity VAT number FR 35 811 396 407.

    “Beepings Zen”: designates a GPS beacon connected to an ISM network working with a Smartphone with the Beepings Application.

    “Client / Clients”: refers to any client / non-professional client (s) purchasing one or more Beepings products or services on the Site.

    “User Account”: designates the User account opened via the Application or the Site.

    “Sigfox”: designates SIGFOX, a public limited company with a board of directors with a capital of 259,097 euros having its registered office at 425, rue Jean Rostand in Labège (31670) – France – registered in the Toulouse Trade and Companies Register under number 514 582 444 and offering international cellular connectivity for the Internet of Things, entirely dedicated to low-speed communications from an antenna and base station infrastructure completely independent of existing networks, such as telecommunications networks and used for the operation of the Beepings Zen product.

    It is expressly noted that Sigfox is a supplier to Beepings and that the two companies are independent of each other.

    “Site”: refers to the “Beepings.com” website allowing the opening of a User Account, as defined in the general conditions of use (GCU) and the online purchase of Beepings products or services .

    “Coverage Territory”: designates the countries covered by the SIGFOX operator delimiting the operating area of the Beepings Zen product. More information on http://www.sigfox.com/coverage.

    “User or Users”: designates any natural or legal person accessing the Site as well as the Application and the services attached to it.

    ARTICLE 1: OBJECT

    The Beepings platform is based on the sale, management and operation of connected products in the field of geolocation of objects, goods or people having consented to it called “Beepings” (the “Site”).

    The online sale of Beepings products is made on the Site under the conditions set out below that the Beepings company makes available to Customers.

    Customers of Beepings and its Application adhere without reservation or restriction to these general terms of sale (GTS).

    The applicable general conditions of sale are those in force on the day of ordering a product or service on the Site, or alternatively on the day of use when activating Beepings products or services or solutions, or alternatively at day of creation of a user account.

    Beepings reserves the right to modify the GTS at any time.

    The Customer is fully aware that the use of Beepings products requires the use of the Application and the subscription of the services attached to it.

    ARTICLE 2 – PURCHASE

    2.1 Accessibility

    The purchase of Beepings products is freely available on the Site to non-professional customers (the “Customer”).

    Beepings uses its best efforts to make the Site and its services available 24 hours a day, 7 days a week, regardless of maintenance operations.

    Beepings reserves the right to modify, interrupt, at any time, temporarily or permanently, all or part of the Site, without prior notice to Customers and without the right to compensation.

    2.2 Order

    Prior to any purchase of a product from Beepings, the Customer must ensure the compatibility of his telephone equipment or that for which the product is intended with the Application by downloading it for free via the Apple store and Googleplay platforms.

    Prior to any purchase of a Beepings product, the Customer must ensure that the area in which he/she wishes to use the product is covered by the Sigfox network (click here to consult the network coverage).

    In case of compatibility, any Customer can buy a product from the Beepings company directly on the Site within the limits of available stocks or through one of Beepings authorized distributors. In case of unavailability, the Site will mention the indicative delivery time of the product.

    Beepings can in no way be held responsible for the purchase of a Beepings product in the event of incompatibility with the telephone equipment or the accessibility of the Internet by the Customer or the User of the Beepings product concerned.

    By purchasing a product from Beepings on the Site, the Customer declares to be aware of its characteristics which can be viewed on the Site.

    The Customer validates his order as stated below. This validation entails acceptance of these general terms of sale (GTS).

    The Customer interested in an article visible on the Site follows the following process in order to establish his order.

    After clicking on the “confirm” icon and after verifying the specifics of his order (product, quantity, price, etc.), the Customer validates the choice of the product or products selected by a click.

    Any order form signed by the Customer by a “double click” constitutes an irrevocable acceptance by the Customer towards Beepings which cannot be called into question in these general terms of sale.

    If the Customer has a special offer, he must first enter a code which has been assigned to him in the field provided. After confirming their payment method, the Customer definitively and irrevocably validates their order.

    ARTICLE 3 – PRICE – PROOF OF TRANSACTION – INVOICING

    3.1 Prices and Payment Methods

    The price indicated in the basket, invoice, customer area is the total price, expressed all taxes included. It includes the price of products and services, handling, packaging and transport costs.

    Beepings reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the Customer.

    The applicable VAT rate is the rate in force on the day of the order by the Customer for one of the products or services sold on the Site.

    Beepings offers Customers to pay the price of their order on the Site, only by credit card. The customer will pay the full price on the day of ordering one of the Beepings products or services.

    Beepings guarantees the security of online transactions. All personal information is perfectly protected and encrypted before transmission to the order processing center.

    3.2 Proof of transaction

    The validation and payment of the order price for a product or service sold on the Site constitutes proof of the Customer’s commitment to Beepings.

    These transactions will be recorded on Beepings’s servers, which will keep track of all transactions with Customers.

    Any complaint relating to the payment of the order price of a product sold on the Site will be addressed as the case may be to Beepings or to the third party responsible for the payment system.

    3.3 Order summary

    After ordering on the Site and paying the price, Beepings will send the Customer a summary of the order and payment corresponding to the price of the service purchased or the product (s) purchased.

    ARTICLE 4 – DELIVERY

    Delivery times are 7 working days in mainland France and 14 days for other European countries. The deadlines are given for information only and are likely to vary depending on the shipping selected. Delays linked to delivery attributable to the shipping can in no way engage the responsibility of Beepings.

    ARTICLE 5 – GUARANTEE – RIGHT OF WITHDRAWAL

    5.1 Guarantee

    All products sold by Beepings SAS are subject to a quality test.

    Each User or Customer has a period of two (2) years after receipt of the package to write to Beepings if they notice a manufacturing defect. Via the “contact” form on the Site or at the following address: Société Beepings, Service Consommateurs, 7 rue Cadet, 75009 Paris, France.

    The warranty does not take into account damage caused by clumsiness or abuse by the Customer or the User.

    Only Beepings will have the power to determine whether the product is covered by the warranty or not.

    5.2 Right of withdrawal

    In the event of the acquisition of a Beepings product on the Site by a Customer, the latter has a period of fourteen (14) days from receipt of the product to exercise its right of withdrawal.

    Customers wishing to exercise their right of withdrawal must inform Beepings of their decision by registered letter with acknowledgment of receipt.

    The Customer returns or returns the product (s) concerned to the company Beepings, without undue delay and, at the latest, within fourteen (14) days of the communication of his decision to withdraw.

    In the event of exercising their right of withdrawal, the Customer alone bears the cost of returning the product.

    The responsibility of the Customer or the User may be engaged in the event of depreciation of the products resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of the products of the company Beepings.

    In the event of exercise of the right of withdrawal, Beepings reimburses the Customer for all the sums paid, excluding delivery or customs costs, upon receipt by the Beepings company of the product (s) returned.

    The products must be returned to the following address: Beepings company, Consumer Service, 7 rue Cadet, 75009 Paris, France, accompanied by (i) the original box in new condition, (ii) the USB cable, ( iii) proof of the order and (iv) the initial invoice.

    ARTICLE 6 – LIABILITY AND CLAIM

    Beepings makes the Site available to Customers for the online purchase of Beepings products and services to enable them to geolocate their objects, goods or persons who have consented.

    The Beepings company declines any responsibility related to:

    – the technical consequences of the connection to the Site or the Application, in particular in the event of connection difficulties due to a technical or material defect, or any problem linked to the congestion of the network or the Smartphone of the Customer or the User Beepings products;

    – the technological limits of antennas and GPS satellite signals and of the SIGFOX network;

    – to any material or immaterial damage caused to the Customer or to third parties as a result of the use of the Site and the Application, as well as to the consequences which may result from this on personal, professional or commercial activities;

    – the consequences for the Customer or a third party resulting from a violation by the Customer or a third party of the guarantees and obligations referred to in these general conditions of sale;

    – direct and indirect damage resulting from the loss of objects, property or people provided with a Beepings product and which could not have been found. Beepings is only bound by an obligation of means and this, within the limits of the Coverage Territory;

    – the non-performance or poor performance of Beepings’ obligations due either to the behavior of the Client or the User, or to the fact, unpredictable and insurmountable, of a third party to the contract, or to a case of force majeure;

    – failure of the geolocation service or Beepings product due to one of the following events:
    1. Failure, insufficiency or congestion of GSM, GPRS and GPS coverage;
    2. Failure, insufficiency or congestion of the SIGFOX network;
    3. Failure, breakdown, alteration or voluntary or involuntary deterioration of the Beepings product, battery discharged or having suffered a damage such as to prevent its proper functioning;
    4. Malfunctions consecutive to the situation of the equipment in electromagnetic fields disturbing the data transmissions – or in covered places disturbing the emission or the reception of the data or the access to the coverage (GSM or GPS);
    5. Works, interventions or manipulations carried out on Beepings’ products or on the servers used to provide the geolocation service;
    6. Inaccuracy or lack of updating of the data provided by the Customer or the User.

    The Customer acknowledges that:

    – Beepings will not be responsible for the cost of returning a product if the area in which it will be used is not covered by the Sigfox network.

    – Beepings cannot assume the connection costs, and in general, all communication costs incurred by access to the Site and the Application and by its use by the User;

    – Beepings endeavors to provide a geolocation of Beepings Zen and cannot therefore guarantee, depending on the case, the nature of the object or property or the identity of the person on whom the beacon is embedded;

    – Beepings cannot be held responsible for any loss of data that may occur during the use of the Site or the Application and / or the impossibility of accessing or using these;

    The Beepings company clearly informed him about the Coverage Territory.

    The User is solely responsible:
    – the use that does not comply with these general terms and conditions of sale of the products of the Beepings company and of the services which it accesses on the Site and its Application;

    – any complaint or procedure brought against Beepings, due to its non-conforming use of the Site, the Application and the products or services of the Beepings company.

    – In any event, Beepings’ liability is limited to the reimbursement of the price of the Beepings product purchased by the Customer.
